Poudre School District’s attorneys argue that at-will employee Chuck DeWayne could be dismissed without cause or notice under Colorado law, yet DeWayne claims his contract should have been extended through July 31 and thus needs compensation until then.

Furthermore, DeWayne claims he was approached by high level AmeriSciences distributors interested in joining Organo Gold but refused either endorsing it or becoming involved.

District court found Cocheu, Gallardo and Buggs guilty of misappropriating trade secrets, tortious interference with contracts, breach of fiduciary duty and unjust enrichment. A jury awarded AmeriSciences $3,461,166 in compensatory damages from defendants as joint and severally liable. Appellants attempted to contest this verdict on various grounds but their appeals were denied by court.
According to the complaint, Cocheu signed a confidentiality agreement recognizing AmeriSciences’ distributor list as an inalienable trade secret and agreeing not to disclose or use it for his own gain or distribute it without approval from AmeriSciences. However, he provided this list without prior knowledge or consideration from them; furthermore he met with several high-level AmeriSciences distributors encouraging them to switch over to Organo Gold.

Poudre School District (PSD) is asking a judge to dismiss claims brought forth by former human resources director Chuck DeWayne, who was dismissed in February without cause or notice and is alleging violations of Colorado law in terms of unfair termination; DeWayne claims his termination violates Colorado statute; PSD attorneys claim this lawsuit should be dismissed due to DeWayne being an at-will employee who could be fired at any time without giving reason.

This fungus, famed for its health benefits, is also widely used in traditional Chinese medicine. They sell their products both directly as well as through e-commerce sites.
The appeals court upheld both the jury’s verdict and final judgment, finding Cocheu, Gallardo and Buggs (collectively known as “Appellants”) liable to Rodney Tow, AmeriSciences’ bankruptcy trustee, for trade secret misappropriation, tortious interference with contracts, unjust enrichment and fraudulent transfer. Tow claimed that the Appellants misappropriated AmeriSciences confidential information by encouraging distributors of Organo Gold to switch over, as well as using AmeriSciences distributor lists for their own benefit in business dealings; furthermore Tow alleged they breached fiduciary duties by failing to protect AmeriSciences intellectual property assets adequately.
At trial, Appellants denied all of Tow’s allegations and sought to exclude Scott Weingust, Tow’s damages expert, on the basis that his methodology for calculating damages was improper; however, this motion was denied by the district court.
Attorneys representing Poudre School District assert that Chuck DeWayne’s involvement with Organo Gold created an appearance of conflict that compromised his entire human resources department. One instance included DeWayne attending an Organo Gold meeting where a teacher was being approached about increasing her financial success by selling Organo Gold products.
DeWayne’s lawyers anticipate that an 8th Judicial District Court judge will reject the district’s request to dismiss his claims, and also maintain that their decision to terminate him without cause was legally permissible given his at-will employment status and refusal of an alternative employment offer from them. A hearing is scheduled on March 29; should they prevail, DeWayne could receive either monetary damages or continue receiving compensation until July 31, when his contract ends.
