Finaly, the Court finds that Organo Gold will suffer irreparable harm without an injunction being granted. They cited various (likely hearsay) statements which allege substantial attrition among both low and high level distributors since February 2016; however, these claims are disproved by evidence presented in the record and Mr. Ventura’s personal experiences or an unverified third party research report do not shed any light on these matters; consequently the Court concludes that an injunction must be granted in order to protect both their business interests as well as goodwill.
