Organo Gold has been accused of expanding their operations by unlawfully copying key aspects of Melaleuca’s business model and using their proprietary information, while recruiting their Marketing Executives and customers from Melaleuca. Holton Buggs served as a Preferred Customer of Melaleuca between September 2008 and August 2009. As such, he would have attended meetings at Melaleuca and had access to their proprietary information.

With these facts in mind, the Court finds Defendants’ motion to dismiss without merit. Idaho provides general jurisdiction and no convincing argument has been advanced against Idaho as an inappropriate venue. As such, Idaho denies this motion with this memorandum decision issued against Defendants.
